Terms of Use
These Terms are a binding agreement between you and Fashizel (“we”, “us”) governing your use of the Spot app (com.fashizel.spot). By downloading or using Spot, you agree to these Terms. If you don’t agree, don’t use the app.

Not medical advice — read this first
Spot is a fitness tool, not a medical service, and its coaching is not medical advice. The app — including AI-generated suggestions about weights, reps, exercises, and recovery — is for general informational and educational purposes only. It does not diagnose, treat, or prevent any condition and is no substitute for a qualified physician, physical therapist, or trainer.
Strength training carries inherent risk of injury. Consult a healthcare professional before starting or changing any exercise program, especially if you have an injury, a medical condition, or are pregnant. Always use safe form and appropriate weights, and stop if you feel pain or are unwell. You are responsible for deciding whether any suggestion is right for you, and you use Spot at your own risk.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Spot, and old enough to form a binding contract. If you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian.
Your account
You can start anonymously or sign in with Google. You’re responsible for activity under your account and for keeping access to it secure. Information you provide should be accurate, and how we handle it is described in our Privacy Policy.
License to use the app
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Spot for your own non-commercial training. We reserve all rights not expressly granted.
Acceptable use
You agree not to:
- copy, modify, reverse-engineer, or create derivative works of the app, except where the law expressly permits it;
- resell, sublicense, or use the app to build a competing product;
- disrupt, overload, or attempt to gain unauthorized access to the app or its backend, or bypass any security or abuse-prevention measure;
- misuse the AI coach — for example to generate harmful content or to submit other people’s personal data without permission; or
- use the app in violation of any applicable law.
AI features
Spot’s coaching is generated by a third-party AI model from the data described in our Privacy Policy. AI output can be inaccurate or incomplete; the model proposes and our code applies changes deterministically, but every suggestion is yours to accept or dismiss. Treat AI coaching as guidance, not instruction, and apply your own judgment (and the medical-disclaimer above).
Your content
Your plans, logs, notes, and coach messages are yours. To run the service — for example to sync your data and generate coaching — you grant us a limited license to host, process, and transmit that content, including sending the relevant parts to our AI provider, solely to operate and improve Spot. We don’t claim ownership of your content and we don’t sell it.
Subscriptions and payments
Spot is free to start. If we offer paid features, they are sold as subscriptions through the Google Play Store and managed via RevenueCat. Prices and terms are shown before you buy. Subscriptions renew automatically until cancelled; you manage or cancel them in your Google Play account, and billing and refunds are subject to Google Play’s policies.
Intellectual property
The Spot app, its name, design, and software are owned by Fashizel and protected by intellectual-property laws. The exercise catalog is derived from the public-domain Free Exercise DB. These Terms grant you no rights in our trademarks or branding.
Third-party services
Spot relies on third-party services (including Google Firebase, Google Sign-In, our AI provider, and the Google Play Store). Your use of those services may be subject to their own terms, and we’re not responsible for them.
Disclaimers
Spot is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted operation. We do not warrant that the app or its AI coaching will be error-free or will produce any particular training result.
Limitation of liability
To the maximum extent permitted by law, Fashizel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) Spot — including any injury resulting from exercise you choose to perform. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50. Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold Fashizel harmless from claims arising out of your misuse of the app or your violation of these Terms or applicable law.
Termination
You can stop using Spot and delete your account at any time. We may suspend or terminate access if you breach these Terms or to comply with the law. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and intellectual property) will survive.
Changes to these Terms
We may update these Terms as the app evolves. We’ll revise the date above and surface material changes in the app. Continuing to use Spot after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of [governing jurisdiction], without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of its courts, except where mandatory local consumer-protection law gives you other rights.
